Potentially thousands of consumers have been mis-sold timeshares at the Golden Sands Resort in Malta over the last 17 years.

Many timeshare owners at Golden Sands were sold timeshares by Azure and told that they would be able to sell them at a healthy profit because “demand was high”. However, in December 2019 Azure announced it was closing its sales decks at the resort in Malta. The Azure companies involved are now in liquidation.

Both Azure Services Ltd and Azure Resorts Ltd copied the model of Silverpoint and Resort Properties where they often enticed unwitting consumers to buy a bundle of timeshares as an investment. Azure XP Ltd is a company that has appeared more recently to sell a points based product, however, some of the service providers for this product have also gone into liquidation.

Azure have mis-sold timeshares on finance….but perhaps not all of them!

Azure Services Ltd is known to have signed consumers up to credit agreements even though they didn’t have a Consumer Credit Licence, and although the FCA has now chosen to make a validation order regarding these loans, claims against lenders are far from over and maybe just beginning.

The FCA has condoned the manner in which Azure presented finance applications to some lenders were approved based on the consumers “credit score” as opposed to being based on “affordability”. The FCA has suggested that loans should be written off where affordability is proven to be an issue, which will come as welcome relief to many elderly people, who in particular, were targeted by Azure.

The FCA has also stated that whilst Azure claim to have followed a specific sales procedure, the procedure in question and the sales journey that many consumers experienced, were two different things. The FCA further stated at point 84 of it’s decision, that one lender failed to conduct any appropriate monitoring of its Agent (Azure), therefore, they can’t demonstrate that there was no pressure selling involved.

At point 86 of the FCA report, the FCA concluded that of the customers that they had spoken to, none had been asked to provide any proof of income.

The FCA stated in point 87, that allegations they had received from consumers surrounding the pressure selling and mis-selling of timeshares and/or the finance agreement, appeared to coincide with similar allegations that had also been reported to FOS.

We are aware of these issues, and we are currently pursuing a large number of claims on behalf of our customers where Barclays Partner Finance have been the credit provider.

Maybe the best quote from the FCA relates to point 81 of it’s document, where they suggest that they were not satisfied that the processes put in place by Azure and one specific lender, had resulted in their customers being treated fairly.
